In their article, Drs. Bronars, Foster, and Woods discuss the Department of Labor’s (DOL) proposed salary test for the white collar exemption to the Fair Labor Standards Act (FLSA). The authors also explain the DOL’s rationale for setting the salary test at the 40^th percentile of the nonhourly pay distribution and demonstrate some of the problems employers will face if they are required to comply with the proposed salary test.
