Edgeworth Client Prevails in Federal Lawsuit Alleging Discrimination

In 2015, a single plaintiff sued Abbott Laboratories for alleged race discrimination and retaliation in a termination decision.  Edgeworth Economics Partner Dr. Deborah Foster was retained to consult on behalf of Abbott Laboratories, which was represented by Kirkland & Ellis. Dr. Foster filed an expert report, provided deposition testimony, and ultimately testified at trial in federal court in Chicago as the damages expert in the case.

On August 25, 2021, following the two-week trial, an eight-person jury unanimously returned a complete defense verdict, siding with Abbott on all eight of the plaintiff’s claims. At trial, Dr. Foster carefully and thoroughly explained to the jury why the damages model put forward by the plaintiffs’ economic expert was flawed in numerous respects and should be rejected.
