California Wage and Hours Class Action for a National Retailer

In 2014, Edgeworth Partner Dr. Deborah K. Foster provided a declaration and deposition testimony on behalf of a nationwide clothing retailer in a California class action matter involving meal periods.

Dr. Foster used the company’s time and payroll records to examine the frequency of meal period exceptions, whether or not evidence of a common policy existed, and whether the named plaintiffs were sufficient class representatives.

In September 2016, Dr. Foster’s valuation of potential claims outstanding related to rest breaks and post-shift work time were presented as proffered testimony to the US Bankruptcy Court, District of Delaware in support of the retailer’s proposed restructuring plan.
