Class Certification Denied

Principal Consultant Sushrut Jain was retained by the Defendant in the class certification stage of Mirabella v. Vital Pharmaceuticals, Inc. Mr. Jain submitted a Declaration explaining why the claim could not be established on a class-wide basis and a Rebuttal Report outlining the flaws in the damages analysis of the Plaintiff’s expert.

The class was denied certification based on lack of ascertainability.
