Dr. Lopez explains several economic issues involved in the case, specifically those at the nexus of royalty apportionment and stacking, determining the maximum overall royalty burden for all Wi-Fi standard essential patents (SEPs), and accounting for the variation in SEP values. He discusses how the top-down approach may help insure patent holders are awarded royalties that reflect their technological contributions while simultaneously addressing the risks of royalty stacking.
