Interview with DG Xu Kunlin of China’s NDRC

Dr. Fei Deng and Yizhe Zhang of Jones Day interviewed Director General Xu Kunlin of the Bureau of Price Supervision and Anti-monopoly Under the National Development and Reform Commission (NDRC) of the People’s Republic of China, regarding NDRC’s recent enforcement activities, development of policies, and future initiatives.
The interview covers a number of hot topics, including the ongoing auto industry investigations, assessment of resale price maintenance (RPM), view towards patent trolls, determination of FRAND royalty rates, leniency, and calculation of penalties for antitrust violations. DG Xu also shares his view on an investigated party’s right of defense and the relationship between antitrust policy and industrial policy in China.
