Shaping How Economics is Used in Antitrust Law

In re: Hydrogen Peroxide Antitrust Litigation, Dr. John Johnson served as a consulting economist to Arkema Inc. on the appeal arguments made to the Third Circuit. Dr. Johnson assisted counsel in developing economic arguments used before the appeals court to demonstrate the need for a rigorous analysis of competing economic testimony at the class certification phase. The court’s agreement with Dr. Johnson’s arguments has made rigorous analysis necessary in such cases today.
